Federal Cost Ordinance on the Genetic Engineering Act in a new version

Dr. Petra Kauch

The Federal Cost Ordinance on the Genetic Engineering Act, as amended on July 18, 2016 (Federal Law Gazette I p. 1666 – BGenTGKostV), regulates the fees and expenses for the imposition of costs for individually attributable public services under the Genetic Engineering Act, insofar as the public service under the Genetic Engineering Act is related to a federal activity. The states have each enacted their own laws for public services under the Genetic Engineering Act, insofar as these public services are related to state law.

The Federal Cost Ordinance under the Genetic Engineering Act has now also been revised by the Act Updating the Structural Reform of Federal Fee Law, dated July 18, 2016. Article 4 of the Act incorporates changes to other laws. Article 4, paragraph 14 of this Act refers to the amendment to the BGenTKostV (Federal Cost Ordinance on Genetic Engineering). This stipulates that the Federal Cost Ordinance under the Genetic Engineering Act has been repealed. The validity of the BGenTKostV was previously limited to August 13, 2018. It has now been extended until January 1, 2021, because the amendment to Article 4 of the Act Updating the Structural Reform of Federal Fee Law only takes effect on January 1, 2012.
